GENERAL

These Terms of Use apply to the use of the Kyyti application and to the liabilities and obligations between the user and the service providers offered in the Kyyti app. In order to use the Kyyti application and to purchase services with it the customer must agree to these terms and conditions and to the Kyyti Operointi Oy privacy policy. The user must read these Terms of Use thoroughly before using the Kyyti application.

KYYTI APP IS A MOBILITY SERVICE AND A COMBINATION SERVICE

Kyyti application (hereinafter “Kyyti app”) refers to a mobile app called Kyyti, which can be downloaded to iOS and Android mobile devices and which provides information on transport services and with which these services can be ordered or purchased. Kyyti app is a mobility service and a combination service as defined in the Finnish law for transport services. Kyyti app is owned by Kyyti Operointi Oy.

WITH KYYTI APP YOU CAN BUY TRANSPORT SERVICES

With Kyyti app It is possible to buy both Kyyti transport service, offered by Kyyti Operointi Oy itself, as well as other transport services which have a resale agreement with Kyyti Operointi Oy.

SERVICES ARE CHARGED WITH THE PAYMENT METHODS AVAILABLE IN KYYTI APP

A commitment for payment is formed when the user confirms the order. The vendor for the services sold in Kyyti app is Kyyti Operointi Oy. The user can store one or several payment methods onto his or her user account. Kyyti Operointi does not store the detailed information on the payment methods in its customer register, but the information is stored by the payment service provider that Kyyti Operointi uses. The payment service provider is shown in the Kyyti app when storing the payment method. Payment is charged from the payment method chosen by the user. This can be for example an automatic charge from a credit card.

THE USER ACCEPTS THE TERMS AND CONDITIONS OF THE SERVICE ORDERED

When buying or ordering a service offered by the Kyyti app for the first time the customer is required to accept the terms and conditions of the service in question. The terms and conditions or the location for the terms and conditions are shown to the user in the app. The user must read the terms and conditions thoroughly before using the service. By ordering a service using the Kyyti app the user makes a binding order on the service in question and accepts the terms shown when making the order. Terms and conditions and the delivery processes for different services may vary.

KYYTI APP PROVIDES THE INFORMATION REQUIRED TO USE A SERVICE

When buying a service using the Kyyti app the user gets the information needed to start using the service (e.g. a ticket or other means of identification) and a receipt of payment. The receipt can be delivered also via email if so desired. When selling services provided by others, Kyyti Operointi Oy is not liable for the correctness of the information submitted by the service provider. Kyyti Operointi Oy is only liable for the correctness of the information concerning the Kyyti transport service.

THE SERVICE PROVIDER IS LIABLE FOR THE DELIVERY OF THE SERVICE

The service provider delivers the service ordered by the user in accordance with its own terms of use. Kyyti app gives instructions for using the service as instructed by the service provider. When selling other service providers’ services, Kyyti Operointi Oy will not be responsible for any errors in the delivery of the service provider. Kyyti Operointi Oy is only responsible for the delivery of its own Kyyti transport service according to the terms of Kyyti transport service which can be found at www.kyyti.com.

THE USER IS RESPONSIBLE FOR DATA ENTERED IN THE ORDER

The user is responsible for the accuracy of the data that he or she enters in the order and for the mistakes that he or she makes in the order. The user cannot cancel the purchase or the order of a service on the basis of incorrect information provided by the user. Cancellation policies of different services may vary and they are defined in the terms of each service provider. Please carefully check the order you are making in the Kyyti app before confirming the order.

THE USER MUST ENSURE THE OPERABILITY OF THE APP IN GOOD TIME

The user should always make sure in good time that he / she is able to present the necessary information and identifications in the Kyyti app. Should the device which hosts the Kyyti app be out of order or unavailable for whatever reason (e.g. out of battery) and thus the user be unable to prove the right to use the service, the user must prove the right in an alternative way or to be able to buy the access in an alternative way if possible. An alternative way to verify access to a service is explained in the terms and instructions of each service and it varies between different services. If it can be proven that the user had a valid right to use a service and for a non-user related cause this could not be shown in the Kyyti app, the user will be given a voucher that covers the expense of buying the service in an alternative way. The voucher can be used to buy services using the Kyyti app.

FEEDBACK AND RECLAMATIONS

Feedback and reclamations concerning Kyyti app must be delivered by email at [email protected]. Feedback can also be sent by using the Kyyti app’s customer support function. Instructions to use Kyyti app can be found at support.kyyti.com.

PROCESSING OF PERSONAL DATA

Kyyti Operointi Oy collects personal data of the users. In order to use the Kyyti app the user must provide his / her consent to the processing of his / her personal data according to the privacy policy of Kyyti Operointi Oy. The privacy policy of Kyyti Operointi Oy provides the information required in articles 13 and 14 in the General Data Protection Regulation of the European Union (2016/679).
